Ah hum...everytime there's been a cut in aid to the district our leaders come out and tell us programs will be cut and our kids will lose out...well guess what...the kids have felt the brunt of aid reductions as long as I can remember...

The scare tactic has been effective as a means to gain funding so our leaders can inflate the salaries of the "chosen ones", implement programs that facilitate political paybacks, and support nonsensical expenditures like the rental of the administration building on the Parkway....

The place to start is electing new board members ...so let's get this show on the road!

CITIZEN'S REVIEW BOARD UNDER CONSTRUCTION

A few years ago, this writer started CILEA, an acronym for Citizens Initiative for Law Enforcement Accountability. The mission ...accountability in cases that affect the community's quality of life and improving relations with law enforcement and citizens, but a citizen's review board was never initiated.

In recent days this community has been plagued with continuing allegations of wrongdoing concerning Utica's Police Department...and controversy has placed this community on edge and placed our officers in jeopardy while performing their jobs. It's not healthy, it's dangerous for our officers and it creates a hostile environment not conducive to building a healthy partnership in police-citizen relationships.

It is my understanding that some time ago, Cassandra Harris -Lockwood and the Utica Police Department entered into an agreement to address community complaints through a conflict resolution program. Not sure of all the details, but do know that any complaint that was to be discussed was on a confidential level. Well, we saw what happened there...the agreement obviously was breached when Lockwood exposed a video of what is alleged to be an officer planting drugs on a suspect.

Having taken many conflict resolution courses, this breach of good faith destroyed any future chance of resolving conflict in the community. In my opinion... it was disastrous and created an heightened level of mistrust between law enforcement and the community.

Let's put it into perspective....we have living amongst us ruthless thugs who at any given point in time would love to off an officer, rather than look at them..we don't need another Tom Lindsey tragedy..we are playing a dangerous game.

There must be in place a venue for resolve...the community and the police department must come together and an initiative in building a relationship of trust and partnership is not an option...it is a necessity!

Therefore, as the founder of CILEA, I am compiling a list of names of candidates to sit on a citizen's review board. The criteria: candidates must be logical, possess critical thinking skills, they must be impartial, possess some knowledge in the areas of conflict resolution, the law, understand the concepts of human and civil rights. A candidate must possess the ability to gather and synthesize information and most importantly...have absolutely no political connections or influence.

I am hoping at some time within the next few days to engage in dialog with the Mayor and the Chief of Police to gain their co-operation. Regardless, this Citizen's Review Board will be adopted, along with a mission statement, with or without the blessings of the Utica Police Department.

Meeting the outpouring of generosity on my facebook page by friends who want to help this family, I think the best thing we can do is stockpile them with necessities in hopes that CPS notices that the community has risen to the occassion of a being their support group...helping them get through the hard times they are experiencing.

Culturally, their eating habits are a little different from the normal American cuisine, but beef, vegtables and fruit seem to be a staple that we're all familiar with. With the monetary donations received yesterday,a gift card from their nearest grocery store, (not knowing if they have a vehicle, it's the best choice), Save-A-lot on Oneida Street will be purchased for them, this way they can purchase other items of necessity; diapers, cleaning items, etc.

The other thing that I'm concerned about is the thin mattress in the child's room....hoping that a local store will donate a twin size bed and mattress so (s)he can find comfort while (s)he drifts off to sleep...

The effort to help this family will continue...and then seeking out others who are in desperate need in our community will be the mission shared with many.

1663 HOWARD AVE .....A HOUSE THAT'S CALLED A HOME..

My day started early this morning in putting together the story of the Sudanese family who was literally torn apart when a call into the Utica Police Department alleging domestic problems at 1663 Howard Ave facilitated Child Protective Services in removing the small children, and charging Abraham Kuol and Panda Madet with endangering the welfare of a child.

Utica's news sources jumped on the story and rode it with sensationalism in an effort to sell papers and increase viewer participation, but not one news source took the initiative to dig further....that would take too much energy...and they like to feed the public their twisted perception of what transpires.....they have to ..in order to keep their out-sourced paper alive ....

At approximately 9:30 this morning I made a phone call to Dwight Johnson the landlord of record to the property at 1663 Howard Ave. It was the second call I had made in two days...but finally got a response. The first question I asked was if I was speaking to Dwight Johnson and he acknowledged that he was the party in question. I then asked him if he was the owner of the property at 1663 Howard Ave and he responded that he was not. I pushed the issue further and asked him if he had ads on websites advertising this and other properties as rental properties that listed him as an owner with this phone number and he finally acknowledged that he was the owner. He asked how I found him and I reiterated that he was named on websites as the landlord looking to rent property....and so we got into a discussion...he was very forthcoming in answering some questions.

I asked him about the tenants; Abraham Kuol and Panda Madet reading from an article of what had transpired days ago. He said he was never notified of the incident nor was he aware that there was no heat in the apartment but was aware of the cockroach problem. He stated that Abraham, the tenant, moved into the apartment around March or April of last year, about the same time as the 1st floor tenant Ms. Potter. He said that it was shortly after that, around May or June, that Ms. Potter notified him that there was a presence of cockroaches and she thought they were coming from the upstairs apartment. She also called a few times regarding some arguing and the children being up late running around. Johnson said that he bought roach traps and placed them in both apartments in hopes of eliminating the problem, but that didn't work so in September an exterminator was called, Ms. Potter paid the exterminator and it was deducted from her rent.

Johnson stated that Abraham didn't want the exterminator to enter the attic, which was accessible from their apartment, so a thorough extermination was not conducted. Johnson stated that he never followed up with another extermination, and Ms. Potter indicated to him three weeks ago that the presence of roaches subsided.

Johnson told me that Abraham was not receiving any public assistance, was employed for a long period of time, according to someone that recommended him for the apartment, not recalling his employer, but did however ask him a few months back to sign a landlord statement so he could receive help with heating expenses through the HEAP program. Johnson told me he signed the landlord statement for him.

It was on the same day that Abraham encountered the problem, which subsequently led to his arrest, that he gave Johnson $200.00 toward January's rent of $450.00. Johnson said that Abraham was late on his rental payments but always paid.

Johnson owns properties throughout Utica and stated that he has no codes violations and is always compliant with inspections, even though the apartment has not been inspected in about a year and a half by Utica's Codes Department or Utica's Fire Department. He stated that he lives in Jamaica Queens is always available to his tenants and has two apartment rental managers here in Utica to take care of any problems that may occur.

Johnson stated that Abraham never called him about about any problems at the apartment except for the one time there was no hot water. Water was leaking into the downstairs apartment recently and the tenant downstairs called Johnson and the problem was resolved.

After I spoke to Johnson it became obvious that Abraham had not mastered the art of the English language. Johnson stated that Abraham was in America for what he believed to be a while, but still spoke broken English and did not always grasp the concept of a conversation, it was at that point in time I truly believed that this was a family who had fallen on hard times and a plea to my facebook friends for donations was met with an outpouring of generosity. Food, blankets, money, clothes, toys were immediately made available for pick up and so my daughter and I delivered the donations with the assistance of two uniform officers from the Utica Police Department.

As we approached the front door there was a sign posted, "Please close the door". We knocked and there was no response so we opened the door and knocked on the inside door to the first floor apartment. The hallway was a bit cluttered with what appeared to be a box of broken plexiglass and the molding on the side of the stairwell was missing, some of which was placed in the box of plexiglass. There was a stroller on the landing going up to the second floor apartment. A rather decent stroller, one showing a bit of wear and tear but do-able. The stairs also showed signs of wear and tear, slippery for they were absent carpeting or any type of slip-resistant matting.

As we approached the second floor apartment door, it was open so we stepped inside, with the officer on the step behind us, and placed the bags of clothing, food and toys inside the door. Upon looking into the apartment one can see the placement of furniture; a tv, couches, and an area rug....and a door to the left had a mattress, a thin mattress placed on the floor with blankets and pillows carefully laid on top. The stove had a disconnected gas line. The house was a modest house, some paperwork on the counter-top, but nothing that would send a red flag up indicating that these people didn't provide the best they could for their children. It was neat...and I did not see any cockroaches crawling around...but I was only at the doorway.

Although we called out for the tenants numerous times..there was no response...but the downstairs tenants said they were home....they must have been hiding...fearing the worst.

We left..I was saddened to think that this family has been portrayed by our media sources as the worst parents in the world. I don't believe for one minute that's the case. They represent the struggles of families in America today. Black, white, yellow, ...it doesn't matter...we are all people ...we all are struggling, we need to help each other.....my prayers to this family...and additional purchases will be made throughout the week to help them...and others.

I may loose a couple of facebook friends but I have to say what I have on my mind....hey you, shit for brains...you ..the poster who feels it necessary to condemn the Sudanese family who were obviously suffering without food, heat and the basic essentials that most of us take for granted daily....assess the situation before you cheer on a government agency taking their children. These are people ...who sought refuge here from persecution from their government...now we persecute them instead of offering community policing like they do in other countries. It would have been more helpful if a social worker, who spoke their native tongue, would have been brought in to assist them in translating what was happening that brought them to conflict, offered them a warm meal and shelter..and made an attempt to contact the landlord and codes to inspect what other problems may have existed that brought them to the point of conflict. Being hungry and cold is enough to raise anyones anxiety level..a precursor to conflict.

There are no heroes here...just a family torn apart by a system that failed immigrants who sought refuge in a country that is founded under the premise of freedom ...God have mercy on us....we have condemned the poor, the helpless, the hopeless....what a community!

It's no secret that Linda Fatata and Bobby Sullivan were quickly ushered out of City Hall by former Mayor King Roefaro last year and the question keeps popping up as to whether or not they will be returning to City Hall to their respective positions or other positions within city government...so I've decided to weigh in on the subject.

Personally, there are no people more qualified for the positions once held by Linda and Bobby...then Linda and Bobby. We all know that it's difficult to work in an environment where politics governs one's right to be employed. Out of experience, I know that the propaganda machine was in full force under the Roefaro regime, in an effort to discredit, malign and propagate rumors as to their incompetency, but that is par for the course when politicians find that they are challenged, number one, by those who have more knowledge and expertise, and two, go against the grain.

Roefaro, at the time of their dismissal never gave the public a legitimate reason as to why they were terminated. His excuse at the time was his need to cut back because of budgetary reasons...yeah, I believed that.

Roefaro and his cronies were experts at utilizing the media to get their message to the public...usually tainted and undoubtedly spun giving the appearance of righteousness and necessity, but I support the premise that if you fell out of grace with the powers to be, then you were doing the right thing, not going along with the status quo or the agenda of the Mayor or his wanna-be powerbrokers.

The people have spoken, Mayor Palmieri now sits at the helm and if he feels that both Linda and Bobby should return, then I say give them the benefit of the doubt...cast aside all the propaganda that was spewed by the previous administration....and open our minds to the fact that these once seasoned employees may be the best thing that could happen in moving this city forward....

I guess one of the questions most asked of me in recent days is "Where's Danny LaBella?".....so of course, I checked with a few of my sources and was told that he is no longer the Commish. I also heard rumors that he's lost alot of contracts with his security company to a security company out of New Jersey.

He's been seen in recent days....at Chanantry's on French Road and I've seen him a few times at or around Parkway Drugs on Culver Ave. I think he's been hanging out there for it's said that his daughter, has or is about to, open up the former Femia's Parkway Cafe, next door to Parkway Drugs, but their facebook page says they were not bought out...so I guess we'll have to wait and see.

It's funny cuz we really haven't seen or heard very much from him in the last months of Roefaro's reign, word has it that although he was on the City's payroll as Commish, he spent a great deal of time in Florida at his brother's house...home now...but only because his daughter is expecting....

Geez.....funny how people who are in the limelight all of a sudden disappear from public view....I wonder why?

Well, I'm gonna follow up on some of these leads and see what develops...in the meantime....the Danny Disappearance Dilemma has some dumbfounded...but if you follow the yellow brick road....we may be able to bump into the Wizard and ask him to look into his crystal ball and give us some clues as to "Where in the World is Danny LaBella"

When someone decides to do something of a criminal nature they usually call an attorney, someone they entrust with the particulars of their case, holding in total regard the lawyer-client privilege assuming that whatever is discussed between them will be held in strict confidence, not to be divulged to anyone...it goes without saying.

Recently it came to my attention, as it has in the past, that a specific attorney finds it necessary to breach that lawyer-client privilege, by discussing the particulars of a high profile case with anyone and everyone within earshot. But the isn't the first time. I have witnessed myself this same attorney breaching confidentiality, clearly misconduct on the part of the attorney representing his client.

Everyone is entitled to representation ..everyone is entitled to a defense, but it is of a serious nature when that defense has been compromised because a loud mouthed attorney decides that confidentiality is trumped by their need to tell everyone the strategy for winning the case for the purpose of generating business and promoting their self-worth.

To all those who have cases pending, that are of a high profile nature, speak to your attorney..remind them, (HIM), that lawyer-client privilege is serious and any breach of privilege may result in disciplinary action...

Just to let you know...you may be the subject of conversation...that of which you thought was of a confidential nature.

UTICA PHOENIX POSTS CAPTIONED DASHCAM VIDEO...HANG IT UP! ALLEGATIONS HAVE NO MERIT!

Why don't they simply give it up...! Utica Phoenix now finds it necessary to post the dashcam video on Youtube complete with snippets of a narrative, (or captions), which on its face has absolutely no merit to the allegations that the police officers are alleged to have planted drugs. NONE WHATSOEVER!

The half-dozen or so narratives, (captions), start off with the names of the defendants and the reason for the stop, that being failure to stop for a stop sign. It goes on to say that there was no smell of pot or a burning blunt, however the driver had a suspended license and was subsequently handcuffed.....

Whoever is narrating, (captioning), the video states that the officer pulled out a small bag of marijuana and also states that the officer may have placed that bag of marijuana in his pocket off camera.

Let me stop there....first of all in my opinion , based upon my educational background in the field of criminal justice, the stop, was reasonable, the search was warranted, due to the fact that he was placed under arrest for a suspended license, and the drugs seized, was the finding of a legitimate search and seizure according to criminal procedure. Anything else narrated during this period of time is purely speculative..including what the officer did off camera and the contents of the baggie pulled out of the defendant's coat pocket. We have no way of knowing who narrated, (captioned), the video and therefore no way of checking the credibility of the narrator.

Now briefly touching on the subject of the occupant of the car, it is visually apparent that the occupant of the vehicle was compliant in stepping out of the vehicle. It does not appear that she is objecting to the search that commenced however, it is pure speculation on my part that she may have given the officer permission to search, as often does happen , or the officer had probable cause to do so. The occupant's only urge to resist was at the time the officer reached into her outside coat jacket and recovered what was alleged to be drugs. She was subsequently placed under arrest and a thorough search commenced.

At no point in time did it appear that the officer reached under her shirt to search her person. The video clearly shows the officer reaching into an upper inside coat pocket then he proceeded to check the opposite inside upper pocket.

The rest of the video speaks for itself...the allegations against the officers in question are far reaching and sensationalism for the sake of notoriety seems to be the motive behind the release of the dashcam video.

If Cassandra Harris-Lockwood felt as though the other issues, (ie: the police officer going under the female occupant's shirt or that an illegal search and seizure took place), were of importance, she could have brought those points of interest into the public's view, but now after she's called out on her absurdities, a captioned video appears deviating from the original point of interest; unfounded allegations of wrongdoing by Utica Police Officers.

Look, I'm not saying that illegal searches and seizures don't take place, they do, and we have case law to prove it..what I'm saying here is that if Cassandra Harris-Lockwood alleges that the officers conducted themselves in a manner that was detrimental to society ...then do so with conviction and make sure you have the evidence to prove it...in this case, she failed to substantiate such claims of misconduct and corruption even when providing the full length video.

It's time to move on....

I have to say that I am impressed by what I have seen in the political arena especially when it comes to the actions of our Congressman, Richard Hanna. Never have I witnessed a man so dedicated to his community, he is working tirelessly to improve the area and is visable to his constituency.

RoAnn Destito is still on my radar..as is Assemblywoman Claudia Tenney, Assemblyman Anthony Brindisi, the Utica School District, but focusing on the Harbor Point Project...now that's a biggy!

Our newly elected Mayor has implemented a dress code for the City of Utica department heads and I couldn't agree more. Simple changes such as this will bring a new attitude and professionalism to City Hall, attributes that were lost in the last administration under the goomba squad's reign of power.

The new year brings with it a new administration, new ideas, new problems, new allegiances, but one thing is for sure....ties and sport coats are a direct tie to professionalism..and it was a good call on the part of Mayor Palmieri.

Last year, as quoted in an online article which appeared on WIBX's website, http://wibx950.com/peacemaker-program-aims-to-promote-peace-and-understanding/, Lockwood was credited with bringing the idea for a mediation program to Utica Police Chief Mark Williams stating “I’ve been concerned over the years as so many community people have been about the nature of the relationship between the community and the police...THERE'S NO TRUST" That’s not a good way to have your society run. You have to have the people who are there committed to your safety be trustworthy.” Harris-Lockwood said she is hopeful the Peacemaker Program will bring some healing to the community however, she stressed that it will take time to see change.

Well, well! Her idea to release a snippet of a police stop via dashcam video, certainly supports her mission to create an environment that generates trust ...NOT!

Being a daughter of a former law enforcement officer, and an outspoken advocate for those who have suffered the indignities of corruption, including what I considered to be the premature death of a black man in Utica by law enforcement officers some years ago (ie:Walter Washington) ...I find that Lockwood's conclusion based upon the snippet of a video, does not warrant a reasonable person to conclude that the law enforcement officer acted inappropriately, nor does it build bridges in a community where the existence of a hostile environment is responsible for the deaths of many law enforcement officers within the last year.

Cassandra Harris Lockwood's retraction of her misrepresentation of the facts surrounding this incident is not good enough. She has caused irreparable damage to the community and those who serve in the capacity of law enforcement. Has Utica's Police Department been the subject of controversy in the past? Absolutely. Are all officers above board....not always...but the video serves only to create mistrust, dissension and a unfair characterization of the majority of those who serve us in the capacity for which they were sworn to uphold.

Lockwood's non-profit organization and newspaper was founded on the principle of uniting this community and she has violated every trust bestowed upon her by community leaders... in hopes of moving this community forward.

The Utica Phoenix's irresponsibility in reporting has created a volatile situation in an already hostile and fragile environment.

Recently Cassandra Harris-Lockwood, Editor of the Utica Phoenix, made the decision to release a dashcam video which is alleged to depict a police officer setting up a citizen after a police stop, only to learn that the officer who she identifies as Officer Holt, is NOT the officer who appears on the dashcam video.

Utica, like all other cities, may experience police misconduct and they certainly should be held accountable for such actions, if in fact this is happening, but to report an alleged incident with such disregard of the facts, is seriously detrimental to the department and the community as a whole.

Lockwood now facing the possibility of a lawsuit for defamation of character attempts to mediate as an alternative to litigation..but the damage is done...some will forever hold that image in their minds, placing officers in this community, especially Officer Holt, in a heightened state of danger. His credibility has been destroyed by the irresponsible actions of a Cassandra Harris Lockwood in her quest to gain notoriety...and she should absolutely be held accountable!

As a writer of this blog for over 4 years, I know first hand that credibility is what sets you apart from other media sources...Cassandra Harris Lockwood has a made her mark.....her newly accredited on-line resource can now be regarded as another rag paper....one that misrepresents factual accounts of what is happening in the community and lacks total credibility for she has not yet acquired credible sources from which she can gather credible facts.

Mark Piersma gets a pass..on not responding yesterday...but.only because it was Christmas Eve when I sent a message via Facebook asking him to explain how and why children of United Cerebral Palsy's daycare program were the recipients of donations given through the Stuff the Bus Campaign.

I woke up this morning, hoping that with over 13,000 toys collected, children in need in this community benefited from the charity of others ...but unfortunately in some cases, I know that some may have been overlooked as a result of the ill-handling in the distribution of toys.

Yesterday morning, my four-year old granddaughter, who attends UCP's daycare program told me of presents that the kids received at school. Upon further inquisition I learned that children attending the daycare program, such as my granddaughter who is not in need, were the recipients of gifts donated by the Stuff the Bus Campaign. But that wasn't the only child that received a gift, my other granddaughter, who also attends, was also a recipient and there were many more. The gifts were pricey, one a Easy Bake Oven...surely a gift that would light up the eyes of any little girl in need...

So who's to blame? Louie Tehan? Mark Piersma? WKTV is a sponsor..they along with other sponsors have an obligation to the generous donors who helped make Stuff the Bus surpass their goal, to ensure that all the gifts intended for those in need reach those recipients. Louie Tehan and/or his administration, treated the donations as though it were his own private slush fund...irresponsibly distributing donations to children who were clearly not in need, while portraying to the public an act of good will.

Louie Tehan, in my opinion, has made a living off of helpless, disabled, and over-medicated children who reside in his facility. He is a scavenger, who stops at nothing to enrich his lifestyle. I am witness to some... these children going without the bare essentials ...decent clothing and shoes...they look as though they're poverty stricken, for they are allotted a ridiculously small amount of money to purchase such items....generous workers have on many occasions provided the essentials, on their meager wages...while Tehan and company reap the benefits of housing these kids...so nothing surprises me. ...his total disregard for the mission of Stuff the Bus is just another example of his moral compass...if he has one. He's despicable!

I know one thing is for sure, sponsors should hold Tehan accountable for any and all misappropriations of donations, to ensure that next year's donations will be distributed in the manner for which they were intended.

Mark Piersma I believe had noble intentions but it would probably be a good idea if he reconsider how these donations are distributed and to whom he entrusts to carry out his mission....excluding Tehan et al. from the equation.

Recently a beautiful young woman was stabbed in a prestigious neighborhood in South Utica and I'm hearing some pretty disturbing rumors that the case is intentionally being played down because of the relationship of the step-father of the perpetrator to politicians ...

Reports by our local media convey that the alleged suspect, Nicholas Tuttle was from Cassville, New York, but fail miserably in giving any more information that would lead us to believe that a deal is in the making for this dangerous perpetrator who happens to be the step-son of Utica's Democratic Committee Chair, Mitch Ford.

According to WKTV's website, Tuttle was to appear in court on September 8th but the lack of an update by any media source is a clear indication that something is beginning to smell and the process for justice may just be impeded by political influence.

I personally don't see how the District Attorney's office can proceed, without giving the appearance of a conflict and you can bet your bottom dollar that manipulation of this case has already begun...

The alleged perpetrator holds the key...for his step-father is in a powerful position as Democratic Committee Chair.....sealing the fate of anyone that has anything to do with the disposition of the case, who may be running for office in the future.

So the smart politically correct thing to do would be to get rid of the case in any way possible...connecting with political cronies who will be able to pull off "mission accomplished" with little to no appearance of impropriety....

A political advertisement paid for by the New York Republican State Committee slams 116th Assembly candidate, Anthony Brindisi, in their recent mailing....and it may just be the first nail in the coffin for his Assembly bid.

Much controversy has surfaced relating to some practices that Brindisi engaged in while siting as a member of the Utica City School Board. One particular incident alleges that Brindisi rehired one teacher who was amongst 24 let go by the district, as the teacher's father is associated Brindisi's political campaign. His failure to disclose the relationship brings up the question of integrity and questions his ethical standards.

The flyer quotes the opinion of the Utica Observer Dispatch on 8/4/2011 in which it was opined that, "Brindisi should have just stepped away and recused himself from the vote. Such transparency must be the rule for public officials."

Let's see what else is brought to the voters attention as we approach the election day deadline....looks like Greg Johnson, Brindisi's opponent is picking up momentum. text size A A A August 18, 2011 A staff member at the Securities and Exchange Commission has complained to Congress that thousands of investigative documents have been destroyed by the agency.
Longtime SEC staffer Darcy Flynn says some of those missing papers relate to huge investment banks under the spotlight for their role in the 2008 mortgage crisis.
Flynn is asking Congress to protect him from retaliation after blowing the whistle on document destruction that he says stretches back for 20 years. Some of the missing files involve early-stage inquiries the agency made into the workings of Goldman Sachs, Bank of America and Lehman Bros.
"The same big banks that delivered us the 2008 financial crisis," says Gary Aguirre, a lawyer in San Diego who brought Flynn's allegations to the attention of Congress.
Aguirre, a former SEC whistle-blower himself, is one of many people who are calling for more accountability on Wall Street and for more action from the SEC.
"I just think that when you've destroyed 9,000 files of investigations, it makes sweeping under the table a lot easier," he says.
Iowa Republican Sen. Charles Grassley, for one, is paying attention.
Grassley wrote to SEC leaders about the allegations first reported Wednesday by Rolling Stone magazine.

Grassley says he wants more information from the agency.
"We know that Bernie Madoff — that there were several allegations against him that were never followed up on by the SEC," Grassley says. "So basically I just want to know that the SEC is doing its job to protect middle-class 401(k)s and other investments."
An SEC spokesman says in a written statement that there's nothing wrong with how the agency handled internal documents.

"There's no requirement that every document that comes into an agency's possession in the course of its work must be retained," the statement says.
And that view is getting some support from outside analysts who follow the SEC.
"My initial take on this is it's a tempest in a teapot," says University of Denver law professor Jay Brown. "What appears to be going on here is the SEC would look at a matter, decide not to bring a case, and largely purge the file of documents."
Those documents might include newspaper articles or anonymous tips — anything that might have prompted the agency to start a file called a "MUI," or matter under inquiry, says Jacob Frenkel, a securities lawyer in the Washington, D.C., area.
"A MUI is nothing more than someone has called in with a complaint or some staff person has made a decision that there is something to at least look at, at the most preliminary level," he says.
Frenkel says there's no allegation the SEC tossed sensitive documents from banks it got under subpoena in high-profile cases that investors and lawmakers care about.
Making A Ruling
The debate boils down to this: What does an investigative record mean to Congress? And the courts?
Under the law, those investigative records must be kept for 25 years.
But federal officials say no judge has ruled that papers related to early-stage SEC inquiries are investigative records.
The SEC's inspector general says he's conducting a thorough investigation into the allegations. He tells NPR that he'll issue a report by the end of September.

UTICA, N.Y. -- Boxes like this one will be sent to soldiers serving in Iraq and Afghanistan. This is part of the Oneida County 912ers and the American Legion of New Hartford's campaign "Hearts for Heroes."
Each will be packed with goodies, including candy and crackers. The group says it costs $20 to fill up one box and they are looking for donations to send 912 boxes.
Overseas, soldiers don't have some of these snacks and organizers say this is their way to show gratitude to the military men and women.
"I'm hoping they know how loved they are. How appreciated they are and how much our hearts go out to them for putting themselves on the line. Just let them know they are not forgotten they are loved," said 912ers Treasurer Peg Roberts.

In addition to the snacks, a letter from an elementary student will be included. The group is looking for places to set up their booth.

The race for the 116th Assembly district, as well as other races, is heating up...the question is simply what will voters consider when casting their votes? One thing is for sure, some recipients of Arcuri's letter feel as though he has insulted their intelligence and he has alienated some voters who may have considered Brindisi as their choice in the upcoming election.

It's obvious that Michael Arcuri, loser of the 24th Congressional seat in 2010, and supporter of Assembly candidate, Anthony Brindisi, wants to make ethnicity an issue......a ploy to draw opposing candidate, Greg Johnson into a fight he cannot win.

Forget Arcuri's inference that the opposition and his crew of supporters are Italian haters, or they may be resorting to campaign strategies attacking Italian Americans as being mob affiliated, as stated in his mass mailings to Italian American voters in the community.....the community has evolved over the years and look at issues that affect their quality of life...jobs, recession, economic development, etc. Arcuri's remedial understanding of voters concerns is partly responsible for his recent political demise and now is bringing that remedial thinking into Anthony's campaign, hoping to grasp support from the few remaining mental giants who share in his ideology.

What surprises me is the fact that Brindisi, an educated man, who surrounds himself with so-called scholars and elite socialites would in fact allow or condone such actions by a has-been politico. I've formulated that conclusion, just by the fact that Brindisi has yet to come out publicly disassociating himself with the literature that adorned our mailboxes in recent days.

It's not Arcuri's manufactured prejudice of Italian Americans nor are the voters considering the rumors of the "sins of the father" that will be Anthony's downfall in this election, but rather the campaign strategy of despicable politicians who he has aligned himself with in an effort to get elected.

Talk about politically incorrect! Last years Congressional incumbent and loser Michael Arcuri thought it was a smart thing to send mass mailings out to voters...and as of now, it appears as though the target of those mailings were strictly American voters of Italian descent.

Arcuri pulled the ethnic card...stating that it was time for American voters of Italian descent to stand by Anthony Brindisi, another American of Italian descent who is vying for the vacated seat of RoAnne Destito, (another American of Italian descent), for Assembly, as a way to send a message that negative stereotyping against Italian-Americans running for office, will not be tolerated.

Although in his message Arcuri lacks specificity, it appears that he is implying that opposition candidate, Greg Johnson who is also running for Destito's vacated Assembly seat is engaging in prejudicial comments.

Arcuri states that "it is a subtle but malicious campaign of innuendo and half truth that plays upon past prejudices and tired old stereotypes in an attempt to, for political reason, tie Americans of Italian descent to "mobsters" and "organized crime".

Mr. Arcuri, your allegations are appalling and the mere fact that you have targeted Italian- Americans in crafting a campaign that does nothing but perpetrate hate amongst the diverse groups of people, based on ethnicity, in this community is vile. But what else can be expected from a decedent of the old Elefante-machine regime.

Arcuri endorses Brindisi as the perfect successor to RoAnne Destito and shares with Italian-American voters his opinion as to Brindisi's character...... what a character reference Arcuri has proven to be!

Arcuri, a Congressional incumbent who lost the last election because of the public's perception of his lack of moral integrity, a lack of sincerity, the failure to disclose state contracts which brought to him millions of dollars in personal revenue, who was connected through a "consultant" to the Eliot Spitzer/Emperor's Club Prostitution ring, who was recently under scrutiny for recommending to Senator Schummer a staffer for the position of U.S. Marshall who lied on his application which sparked a federal grand jury investigation, expects us to take seriously his recommendation and endorsement of a candidate for the vacated Assembly seat?   ......Wow...just who we look to for an endorsement....Michael Arcuri.

The letter is clearly straight from the desk of Michael Arcuri, but it's a dirty political tactic of the old Rufie Elefante guard, as they struggle to retain control of dirty Destito's district. I had the opportunity to speak to a Oneida County Anthony Picente's executive staffer this morning regarding the alleged abuse of County subsidies regarding clients selling temporary housing vouchers for purposes of prostitution and drug transactions.

Brian, (pardon me, I forgot his last name), expressed concern and said he would look into it. I hope a corroborative effort to eradicate these abuses are initiated in an effort to reduce the burden on taxpayers who foot the bill .....

Utica's Super 8 Motel in North Utica has become a little like 42nd Street in NYC during its heyday.

In all fairness to County Executive, Anthony Picente and Chief of Police, Mark Williams, I have not contacted them to resolve the problem but I will come tomorrow morning.

According to the information that I am receiving, the place is a haven for prostitution, drug dealing and other illicit activities...a place where prostitutes and drug addicts secure temporary housing through vouchers and then utilize the premises accommodating Johns at the taxpayers expense.

The Oneida County Social Services program has their hands full, and in no way am I placing the blame on any social worker from that department, but rather want to bring to their attention what is a grave cause for concern.

Apparently the scam has taken hold. While Utica does have some legitimate homeless families, due to no fault of their own, and seek the assistance of the Social Services Emergency Housing Program on a temporary basis while looking for housing, there are others who abuse the program.

Recently it has come to my attention that drug users are obtaining temporary vouchers for rooms at the Super 8 motel, only to sell those vouchers in exchange for drug money, while the taxpayers are footing the bill. Pimps and prostitutes then use those rooms paid for by the County to carry out their illicit activities.

On one occasion, a young woman who bragged that she has an apartment in Ilion, housed her small child in the motel across the street, while she conducted business in one of the rooms, paid for by the County's temporary shelter program.

This is becoming an epidemic. County officials and law enforcement need to be aware of the problem that exists and it's time that all recipients of funding from our social services programs be required to participate in mandatory random drug testing to stop the abuse in our system.

We are morally obligated to help the many that are in need...but this is not acceptable, and it must be addressed!

Protecting and Creating Jobs through Griffiss International Airport Development

There's a lot of talk today about redeveloping “Main Street.” Here in the Mohawk Valley we have an unconventional Main Street...Our Airport Runway. We have the most spacious, under-utilized airfield in the northeast, possibly the Country. Now is the time to develop our Airport to create new jobs, protect existing jobs and continue to build a strong infrastructure for years to come.

BACKGROUND

When the Base Realignment and Closure Commission (BRAC) closed Griffiss Air Force Base in 1995, the government instituted a program for helping the communities recover from the economic impact to occur. The Military Airport Program (MAP) provided funds for certain projects.

One of the first MAP funded projects was to be money for building a passenger terminal. When Oneida County transferred our general aviation use from the old County Airport (UCA) to the new airport in Rome (RME) any opportunity to provide air carrier service to our community was lost.
MAP money has been requested, but never allocated for the purpose of rebuilding this asset.

There is a shovel ready plan for a 6.3 million dollar terminal at Griffiss. This facility has not been built due to a lack of political courage to move forward with this plan. There is a need for this facility and it can and will be a catalyst for developing new jobs and protecting the jobs we currently have.

There is a significant Air Force presence at Griffiss. Rome Labs, the U.S. Defense Finance and Accounting Service (DFAS) and Eastern Air Defense System (EADS) employ hundreds of people. These employees are required to travel frequently between Griffiss and Wright Patterson Air Force Base in Dayton, Ohio. These individuals must drive to Syracuse or Albany and fly to Philadelphia, Detroit, Chicago or Washington and make connections to Dayton. There only other option is to drive the more than nine-hour one-way trip.

PROTECTING OUR JOBS. CREATING NEW JOBS.
Creating Commercial Airline Service

The recent merger of Southwest Airlines and Air Tran presents an interesting opportunity for the area. Air Tran had a hub in Dayton, Ohio and Southwest is incorporating this hub into their system.

With local population of over 250,000 people, six colleges and a strong foundation of local businesses, the addition of a terminal building will make the Mohawk Valley an attractive destination for air travel. A link from Griffiss International Airport to a hub in Dayton, Ohio will create air carrier service to the West, North and South without having to drive to Syracuse or Albany.
Protecting Rome Labs, DFAS, EADS
In 2015, there will be another BRAC round. Building a new terminal building will help us to protect these jobs.
Travel time and expense for Rome Labs employees and Defense Contractors will be cut by two thirds, giving them a huge incentive to stay here when BRAC meets.
Securing A Future for Our Current Businesses
There are currently three heavy maintenance companies working at Griffiss: MidAir, Premier and DS2. They are servicing aircraft including Boeing 747's, 777's and Lockheed C5-A's.
Our airport needs to be listed as a commercial operation to help enhance the services provided by these companies. Currently we are classified as a General Aviation Airport, on par with a grass strip airport with single engine airplanes. It is unacceptable that almost twenty years after the closing of the Air Force Base we are in this situation.

Creating New Jobs

To attract any new business development, especially the Marcy Nanocenter at SUNYIT, a commercial air presence will enhance the infrastructure already in place to create a better atmosphere for job creation.

As stated in an article written by me some time ago, relating to recovery monies targeting businesses that were affected by Katrina, five businesses in Utica were the recipients of federal subsidies.

One of the criteria qualifying a business for federal recovery money, was that at least five businesses in the same area were affected. At the point in time that I brought this to light, it was surprising to see the businesses that claimed to be affected.

What does this have to do with anything? Well, seeing that our Mayoral candidate, Bob Cardillo, takes ownership, as a Coordinator for Disaster Recovery, it would be very interesting to see what role he played in securing federal funding to these businesses, if any.......and more importantly... if they had entitlement to those funds.

Maybe I'm missing something, but can someone please tell me why a man, such as Bob Cardillo, would leave the fascinating life in Washington, D. C., or the hustle and bustle of a city that never sleeps, to resurrect Utica, a town ravished by political whores and thieves? Why Mr. Cardillo, does your prestigious career land you an opportunity to be the leader of this politically war-torn town, a place that you escaped from some years ago?

Don't tell me that you love it that much....tell me something more plausible...tell me there's opportunity for self-enrichment and I'll respect you....just don't tell me that your plan to become Mayor of Utica doesn't include self-enrichment schemes because then you're insulting my intelligence.

Embellishment looks to be a strong point, as I critically evaluate and research Cardillo's bio. I've learned, by studying other seasoned politican's omissions in their campaign literature, that the absence of a precise work record, the absence of a critical time period of accomplishments, and the generic placement of information is a dead give-a-way that all conveyed to the voting public is not necessarily what it appears to be.

I am particularly concerned with the timing of Cardillo as Disaster Recovery Coordinator and the granting of disaster funds to Utica businesses during the time frame of Hurricane Katrina. I wrote about funds being filtered into Utica during the Katrina disaster to places like Zogby International and even suggested that fraud may have taken place, for none of the businesses here, were even remotely affected by Katrina.

My research is starting at the point in time when Cardillo was alleged to be appointed as a Disaster Recovery Coordinator and the benefactors to those Federal funds..

I have a feeling this could be very interesting.

Well since Saturday, I have placed two phone calls to Mr. Cardillo's campaign headquarters in an effort to get some answers to some important questions, like for example, now that you have openly aligned yourself with McDonald's mogul et al, what new and exciting ideas are you planning for Utica....but no return phone calls to date.

With the primaries just around the corner, it is essential that Uticans take the time out to critically evaluate the candidates; the good, the bad and the ugly.

I have already started the research, and some things are ugly...very ugly. While many are professing their love for this city and promising re-vitalization, their eyes are set on self-enrichment schemes, surrounding themselves with the dirty dozen who have already raped and pillaged this community, without remorse. They walk amongst us, with an arrogance of entitlement while placing their life size political signs in strategic places, demanding to be idolized and worshipped as our savior ...who will bring us out of the darkness and into the light.

Don't buy it. Chances are the bigger the signs ...the more they have to gain and the more we have to lose.

In the coming weeks, I will bring to you the truth about the candidates. Who they are affiliated with, what their hidden agendas may be, and the importance of voting in a candidate that goes against the grain of status quo politicians that offer us nothing but crumbs amongst the ruins.

BUSY THE FIRST DAY BACK ON THE BLOG

Well, can't say the first day back was uneventful....and it's nice to be back!

After posting the article on Greg Johnson, candidate for the vacated seat of RoAnn Destito, I had the opportunity to speak briefly with Greg and was reassured that he is busy on the campaign trail and hard at work.

Greg brought up some good points, quality of life issues for this Assembly district, and instead of giving some generic political rhetoric, he gave some solid answers to questions posed.

I think it's important to know that Greg is a concerned candidate, and glad that my appeal to him to step it up was taken in the context for which it was intended.....to fire him up.

Hopefully in the next few days I will have the opportunity to interview both Greg and Anthony and give you, the voting public, the answers to some important questions..that is if they wish to entertain my request for an interview.

Looks like New York State lawmakers had more than just their heads up their asses when they voted for the passage of the Equal Marriage Act!

Look, it's legal to pick your nose, but I don't want to see it. It's legal to scratch your private areas, doesn't mean that I should have to watch you do it....same goes for public displays of affection amongst same sex couples...I find that to be equally offensive, and I shouldn't have to watch it.

If I wanted to watch this type of behavior, I could rent a porno like Doug Does Dewey in the Doo-Doo in the privacy of my own home... Keep the public displays of affection out of my face and the face of my children, whose religious beliefs are contrary to lawmakers butt passing laws, and all will be ok. Have a ball.....do whatever you want. Hang from the chandeliers in Victoria Secret's new Push-Up Bra and panties wearing stilettos and fishnets for all that matters.....not my business, butt when you make it my business, by continuously pushing the images on your media websites and local newspapers where my children have access... then it IS my business.

While the Tea Party is actively looking for workers to help Greg Johnson in his bid for election to the vacated seat of RoAnn Destito, the question remains...where in the world is Greg Johnson?

It so happens that while spending the day at the ball park on Saturday, I missed the opportunity to engage in conversation with Assembly candidate, Anthony Brindisi, as he and his wife, braved the heat and humidity and walked house to house campaigning in my neighborhood. I would have loved the opportunity to cut through the normal campaign rhetoric and ask important questions like; if elected what will you do to stop the corruption that exists amongst our elected officials in our community? And of course the most obvious; will you support cutting government contracts that allow former elected officials to collect rental revenue on empty buildings, in an effort to save jobs at the proposed site of Rome's State Correctional Facility?

I have to say that the opportunity still exists to ask important questions, for Anthony Brindisi is visibly out there in the community pounding the pavement, something I have failed to see Greg Johnson engage in.

I stated from the beginning that in order for Greg to become a contender in this years Assembly race, he MUST get out there. Emails asking people to meet him at his office is not going to cut it. Asking people to go door-to-door for Greg isn't going to cut it either. He needs to be visible. He needs to face the voting public on a personal level....even if that means pounding the pavement, on hot, humid days, and he needs to campaign hard with enthusiasm and commitment.

Guaranteed Anthony's door-to-door campaign strategy will work. He is making it personal, he is making an impression on the voters, that he cares enough to knock on their door and spend time with them answering their questions. Now a word of advice to Greg....step it up a bit, or dump your campaign manager because your campaign is lagging in the enthusiasm department and at this rate, you will not be the victor!

Yesterday WKTV shared graphic images of homosexuals swapping spit ....but like that wasn't enough. Today the Utica OD in an effort to boost their falling sales, capitalizes on the images of two homosexuals swapping spit on their on-line website, selling the photo for a nominal fee.

I personally don't care what type of sexual encounters you experience in your lifetime....have a ball or two, but keep it out of the view of children, who who may be too young to understand the moral consequences for choosing this type of lifestyle.

Our community is falling apart. Children being murdered at the hands of others, law enforcement officers shot in the line of duty, and violence that has eroded our quality of life, but the Utica OD and WKTV think it's important to push their twisted images on unsuspecting viewers and subscribers.

Write an article on equal marriage but spare us the graphic images...they are puke worthy...and I vehemently object to that type of journalism...if you can even call it that.

Maybe it was a fluke but a day or so ago I received in the mail a letter from the "Desk of RoAnn Destito" asking me to support Anthony Brindisi for the 116th Assembly seat.

Now personally, I don't have a problem with Attorney Anthony Brindisi and as a matter of fact I think the Democrats finally used the few brain cells they have collectively left in their heads, putting Brindisi up as a candidate, for he is a strong contender, but when RoAnn sends out a letter endorsing him as a candidate, well that changes the whole damn scenario.

Greg Johnson is the Republican's candidate and I like Greg very much and we can't discount the close race he gave Destito in November's election, but Greg will have to campaign hard, real hard, for it's an uphill battle in the fight for the seat against Brindisi, and I'll tell you why.

Brindisi is financially in a position to throw one of the biggest campaigns ever.... add to that visibility, both as a current Utica City School Board member and his trillion commercials on local channels every week promoting the law firm in which he is featured and he's a recognizable face in this race. But don't forget the good ole boys club and it's membership of status quo politicians backing him, along with some of the usual blood suckers in strategic places, who will at any cost promote Brindisi, hoping to continue to feast off that gravy train that Destito created and he's got the edge.

I look at things this way. I think Anthony Brindisi can be his own man. He is capable of leading his own agenda and doing what's best for this Assembly district, but it scares me to think that RoAnn, the epitome of corrupt politicians endorses him and his supporters seem to be that old Arcuri, Roefaro, Destito crew.

Greg Johnson is a newbie but he needs to get his show on the road. He definitely needs to become more visible, knock on doors, attend local functions, and by all means motivate the voters by creating some excitement and controversy...get to the real meat of the issues in this area, spare no one, forget being the nice guy and expose corruption for what it is...leaving no stone unturned, ...and I mean no stone!

While Brindisi doesn't seem to have a lot of negative PR baggage, and is basically a John F. Kennedy protege, he has made a few unpopular decisions while sitting on the Board of the Utica School District, something that Greg needs to capitalize on. The most important thing to remember is putting in your political arsenal a list of associates, such as Destito et al, that connect him with the faction that has literally destroyed this area. That will be your most significant weaponry in winning this election.

You can be the long shot coming down the home stretch, but you have not a minute to waste, Greg. If you want it bad enough, you'll spend every waking minute focused on this election, and that's the way it is ....you're facing off with a hell of a contender..... whose ready to go the distance.

“Bathroom Bill” Empowers Predators

Both houses of the New York State Legislature have introduced a bill known as the Gender Expression Non-Discrimination Act (GENDA). GENDA is often referred to as the “Bathroom Bill” because it would allow any man who says he feels like a woman trapped in a man’s body access to women’s restrooms, locker rooms, and shower facilities. That name has gotten some traction, causing many advocates in the lesbian, gay bisexual and transgender (LGBT) community much consternation.

Senator Duane (D-Manhattan) sponsored the bill, S2406, in the Senate, and Assemblyman Gottfried (D-Manhattan) sponsored the bill, A5710, in the Assembly.
The bill amends 12 sections of the Executive Law, one section of the Civil Rights Law, two sections of the Education Law, five sections of Penal Law, one section of the Criminal Procedure Law, and adds a new section to Executive Law defining gender identity or expression.
The sponsors’ description of the bill states that the bill prohibits discrimination based on gender identity or expression. It defines “gender identity expression” as “having or being perceived as having a gender identity, self-image, appearance, behavior or expression whether or not that gender identity, self-expression, appearance, behavior or expression is different from that traditionally associated with the sex assigned to that person at birth.”
Those sections of the Criminal Law and the Criminal Procedure Law being amended deal with adding “gender identity or expression” to the list of factors that make a crime a hate crime. In other words, those engaging in cross-dressing or other forms of transsexual behavior would now be part of a protected class.
If the bill were to become law, children are left in potentially dangerous situations. For example, if a young female child went into a woman’s restroom and a man followed her into the facilities, her father could not prevent the man from entering the bathroom. If a father tries to stop another male (who is self-identifying as a female) from using the women’s restroom, the father could be charged with a hate crime–a felony offense.

An Empire State Pride Agenda fact sheet regarding GENDA states, “There has never been a reported problem regarding the security of restrooms – including women’s restrooms – in all the jurisdictions where similar laws have been adopted.” Contrary to the fact sheet however, the State of Colorado did notice a series of incidents in the months immediately following the passage of its version of the “Bathroom Bill.” For example:
A female intern at Focus on the Family encountered a man in a women’s restroom in a local airport.

A teen girl saw a man in a women’s restroom at a Colorado Springs-area Wal-Mart. The man then exposed his genitals to the girl.

Two teenage girls discovered a man undressing in a women’s locker room in a Denver-area fitness facility.

A mother and daughter in a Colorado mall bathroom were intruded upon by a man—in his 20s with a red-dyed Mohawk—who spent several minutes in the bathroom.

New Yorkers for Constitutional Freedoms (NYCF) is opposing the legislation. NYCF’s Executive Director, Rev. Jason J. McGuire, defends their organization’s stance. McGuire says:
“I’m a father of little girls. I believe there are supposed to be some places deemed private for obvious reasons. I want my little girls to feel uncomfortable if they are in the bathroom and a man walks in. That is a healthy fear that protects them from potentially dangerous situations.
“The New York State Legislature, or any governmental jurisdiction, should not be trying to desensitize my girls to those unsafe situations. Stranger danger is a good thing.”
The sponsors state that justification for the legislation is that the transgender community is not protected under current law. They say that transgender people, whose gender identity, appearances, behavior or expression differs from their genetic sex at birth, face discrimination in housing, employment, public accommodations and many other areas of life. They further state that they are particularly vulnerable to hate crimes.
In April 2010, the Human Rights Commission of the State of Maine made a proposal to ban schools from enforcing gender divisions on sports teams, school organizations, bathroom, and locker rooms. If students were forced into a particular room or group because of their biological gender, it was perceived as discrimination. This proposal came about because a 12-year-old transgender boy was denied access to the girls’ restrooms. The Maine Human Rights Commission said that was a violation under Maine’s Human Rights Act. If the Bathroom Bill passes in New York State, New York could face the same situation as Maine.
The New York State Assembly passed the Bathroom Bill in April of 2009, by a vote of 97 to 38. It was passed again in 2010, by a vote of 100 to 43.

The Bill awaits action in the New York State Senate Investigations and Government Operations Committee. The committee could act upon the bill any time.

My message comes on the heels of a letter written to DeFrancisco from the Association of General Contractors, asking for support of RoAnn. Flooding problems, and complaints regarding contractors doing work under federally subsidized programs; performing shoddy work using sub-standard materials is causing recipients to become frustrated and angry. My phone started ringing at 8 this morning....nice way to start a day!

These contractors need to re-visit these homes where the work was done and rectify the situations. NOW!

Anyone else experiencing problems with contractors who worked under federal programs such as Growest or the HUD's Home Preservation Program please contact me.

I guess you can say that Mayor Sir-Lies-A-Lot has something in common with our defunct sewer system...shit....and he's full of it! There's no nice way of saying it..it is what it is, and I'm not going for an award in diplomacy!

This past Sunday while many Uticans were cleaning up the remnants of destroyed personal property and literally crying over the damages done to their homes, Mayor Sir-Lies-A-Lot decided to take a trip to Roosevelt Drive to spew more empty promises to those who have over the years suffered from flooding....

Waiting to hear from Emergency Management Agency and more questions posed to FEMA...be back to report. In the meantime, I will be setting up a facebook page where all who have been damaged with the recent flooding can stay informed ...and put in place a plan of action.....

PICENTE ANSWERS THE CALL

LINDA SHUMAKER, SHUMAKER ENGINEERING

Yesterday Oneida County Executive Anthony Picente gave a quick rundown on what the County was doing with their share of the stimulus money allocated for sewer repairs. I'm not an engineer, and haven't grasped the intricacies of the sewer system, but could relate to what was explained.

Picente explains that the County received 25 million funding in no interest loans , with 4 million being forgiven after spending all of its allocation. Five million of that has been spent with Shumaker Engineering in drawing up an engineering systems study to determine the problems with our sewer system.

Municipalities surrounding Utica was the target of the study with a small portion of Utica included, but Utica has received their own slice of the pie, that of which Picente does not oversee, and remains under the control of Mayor Roefaro.

Oneida County is under a consent order to fix the sewer problems and have asked for an extension to complete the work.

That sums it up in a nutshell...or does it? SHUMAKER ENGINEERING, NOW THAT'S A NAME I KNOW.

COUNTY EXECUTIVE'S OFFICE RESPONDS TO MY INQUIRY

In all fairness, Oneida County Executive Anthony Picente's staff member returned my call giving some information as to where the $38.5 million in federal stimulus money went, which was allocated through stimulus grants and loans to update storm sewer projects. Although the response was rather generic, and an itemized list was not readily available as to the percentage of funds already spent and to whom the contract was awarded, to put a plan together stating objectives and goals, at least it was more than I got from Mayor-Sir-Lies-Alot and his cohort Goren something-or-other.

Brian Mooney, I believe that was his name, (excuse me if I have the name incorrect), states that an extension was requested to complete the work on projects to update storm sewer run-offs and so far a plan was created to initiate a plan of action. I asked if at the time the request was made for federal and state funding, wasn't a plan in place? How could federal and state agencies award $38.5 million without knowing what the money was to be used for?

All I know is that Utica and the surrounding areas have been damaged beyond imagination, although small in comparison to places like Alabama, it's still a loss, and someone is going to pay....namely politicians who acted in the capacity of elected officials, who violated the trust of the people they serve.....for they most likely pissed away federal and state money and there's no telling where it went!

Congressman Richard Hanna is already taking action! I made a phone call to his office this morning talking to Brandon Eden, one of Congressman Hanna's staffers, who informed me that the Congressman's office is looking into where the money went that was allocated from the storm sewer projects in Oneida County and Utica.

To reiterate, under the tenure of Congressman Michael Arcuri, stimulus money flowed into the county and the city to update storm sewer projects...but it is apparent by looking at the devastation throughout areas of the city and the county, that nothing has been done with the $38.5 million to date. So where's the money!

I have faith that Congressman Hanna will work in the best interest of those who have been victimized by the the devastating flooding in an effort to provide us with some answers to our questions. His office will keep us abreast. Thanks Congressman Hanna and staffer Brandon Eden, for your quick response.

P.S. Update...Congressman Hanna's, chief of staff Justin Stokes, just informed me that Congress has proposed looking into updating and revamping FEMA's flood maps because some areas have erroneously been designated as flood areas while others have been omitted.

I have asked that they provide me with a list of contractors who may have been awarded contracts for work involving the 38.5 million dollars in stimulus monies.

I'll keep all informed.

BIN LADEN DEAD OR JUST POLITICAL PROPAGANDA?

I hate to be cynical but it's the timing, the lack of physical evidence and the moral integrity of President Obama that leads me to question the validity of Osama Bin Laden's demise.

According to reports, Bin Laden was killed in a firestorm a week ago. You mean to tell me, the magnitude of the death of Bin Laden was unknown to any Arab news media. Al Jezerra didn't get a whiff of Bin Laden's demise ...all was quiet, not a word leaked out? Then he's buried at sea? The number one "MOST WANTED" in the world and not a picture to validate his death.

The gory pictures of Saddam Hussein's sons, when killed by U. S. forces, were televised throughout the world, and Hussein was hanged for all to witness...but Bin Laden, quickly was laid to rest....for it is customary....huh!

Show me the physical evidence of his demise and I'll give it a second thought...until then, nothing Obama says can be trusted. He is a desperate man, pulling out all the stops in an effort to secure a second term... Hey, no one can "one up" him with this breaking news, even Donald may have a hard time doing that.

Wake up America...the propaganda machine is hard at work!
